Scheme Objectives:

To remove an Environmental Agency objection to a residential development within a Zone 1 Floodplain.

Mayer Brown’s Role:

Our client proposed to build 68 dwellings on a land considered by the Environment Agency (EA) as being in Flood Zone 1, i.e. land at little or no risk of flooding. However, the EA still maintained a holding objection to the proposals on the basis that a drainage strategy had not been provided by the developer.

Mayer Brown were instructed to investigate the detail of the EA objection and to provide the information necessary to ensure its removal. As a result, MBL undertook an investigation into the current and proposed on-site drainage regimes and commissioned a suite of soakage tests. The outcome was the provision of an outline drainage strategy which included the design of suitable SUDs techniques for
the proposed development, thus removing the EA objection.
